§ 39-265. Penalties.

  • (a)

    Violation by a minor. A violation by a minor is subject to the jurisdiction of the juvenile court and penalties are set forth in subsection 39-262(a) of this article.

    (b)

    Other violations.

    (1)

    The uniform nontraffic citation and complaint ("UNTCC") shall be the charging instrument for a violation of subsection 39-262(b) or (c) of this article.

    (2)

    The first violation shall be punishable by a fine of one hundred dollars ($100.00).

    (3)

    The second violation within one (1) year and all subsequent violations thereafter shall be punishable by a fine of up to five hundred dollars ($500.00) or by imprisonment of up to six (6) months or by both fine and imprisonment.

    (4)

    In sentencing violations of this article, the municipal court may consider a suspended sentence, probation, community service, or, in lieu of or in addition to any penalty that may be imposed, ordering the violator to obtain counseling or attend classes to improve parenting and child raising skills.
